British Overseas Territory English Common Law jurisdiction The Trade Marks Act 2002 provides for local trademark applications with registration dating from receipt of application. Registration of U.K. Trade Marks Act provides for applications to extend rights under U.K. registration to Anguilla with effect from date of registration in U.K., but an action in Anguilla for infringement of a U.K. registered trademark can only complain of infringement occurring after the date of registration in Anguilla. Service marks can be registered in Anguilla under the International (Nice Convention) classification system. No prior use is necessary but non-use for five years following registration will subject the mark to an action for cancellation. International (Paris Convention) priority is now available. Registration term on local registrations is 10 years and renewable for like periods; term of trademarks registered as U.K. extensions is coterminous with U.K. registration.
Power of Attorney requires no witnesses, but the
form must be notarized.
