Independent Country British Commonwealth English Common Law Jurisdiction Trade Marks Act as amended by Intellectual Property Act provides for local trademark applications with effect from date of application. There is no provision for extension of registration of U.K. trade marks as provided in many other Commonwealth Caribbean jurisdictions, but international priority (Paris Convention) is available, and a U.K. registration certificate may serve as evidence of registrability in the discretion of the Registry Service marks are registrable under Barbados'
international (Nice Convention) classification system. No local use or
intent to use is necessary prior to application but failure to use the
trademark within a period of five years following registration may subject
the mark to an action by an interested party for cancellation of the mark
by the Court. Registration term is 10 years and is renewable for like
periods of 10 years.
