British Commonwealth English Common Law Jurisdiction

The Trade Marks Act provides for local trademark applications with effect from date of application. There is no provision for extension of registration of U.K. trademarks as in many other Commonwealth jurisdictions. International priority (Paris Convention) is not available. Service marks are registrable under Bermuda’s international (Nice Convention) classification system.


No local use or intent to use is necessary prior to application but failure to use the trademark within a period of five years following registration may subject the mark to an action by an interested party for cancellation of the mark. Registration term is 7 years and is renewable for periods of 14 years.


Authorization of Agent form requires no witnesses, no notarization and no legalization.
