Trade Marks Act provides for local trademark applications with registration dating from receipt of application. Registration of U.K. Trade Marks Act provides for application to extend rights under a U.K. registration to British Virgin Islands with effect from the date of registration in the U.K, but a suit in British Virgin Islands for infringement of a U.K. registered trademark can only complain of infringement occurring after the date of registration in British Virgin Islands.

Service marks are registrable in British Virgin Islands only via an application to extend a U.K. registered mark, as above; however, service mark legislation is pending. No local use or intent to use is necessary. International (Paris Convention) priority is not available. Registration term on local applications is 14 years and is renewable for like periods; term of trademarks registered as U.K. extensions is coterminous with U.K. registration.


Authorization of Agent form requires two witnesses and no notarization or legalization.
A separate form is needed for each application.
