The Trade Marks Act provides for local trade mark applications with effect from date of application. The Act also provides for local re-registration of marks registered in the U.K., including service marks but, otherwise, service marks cannot be registered. International priority (Paris Convention) is not available. An action in Guyana for infringement of a U.K. registered trademark can only complain of infringement occurring after the date of registration in Guyana. An International registration designating the U.K. can also be registered.

No local use or intent to use is necessary prior to application but failure to use the trademark within a period of five years following registration may subject the mark to an action by an interested party for cancellation of the mark. Registration term on local registrations is 7 years and is renewable for periods of 14 years. The term of trademarks registered as U.K. extensions is coterminous with U.K. registration.


The Power of Attorney form needs to be signed and notarized.  For non UK-based applications, the “Statement A” and "Declaration" forms need to be signed and notarized. Please note that for non UK-based applications a separate Statement A and a separate Declaration are needed for each class application.
