Independent Country British Commonwealth English Common Law Jurisdiction St. Kitts - Nevis is more formally known as "St. Christopher and Nevis". Trade Marks Act, which came into force June 1, 2002, provides for local trademark applications with effect from date of application. Service marks can now be registered under the Nice Agreement (8th Edition) international classification system which has been adopted. Paris Convention priority is now available. Registration based on a UK registration is no longer possible. Current UK-based registrations and local registrations will continue under the new act for their unexpired terms, while new registrations will be for a tern of 10 years, with renewals for further periods of 10 years. Licenses may now be recorded and are ineffective against third parties unless recorded. Licenses, to be recorded, require quality control. No local use or intent to use is necessary prior to application but
failure to use the trademark within a period of three years following
registration may subject the mark to an action by an interested party for
cancellation..
