Independent Country British Commonwealth English Common Law Jurisdiction Trade Marks Act as amended provides for local trademark applications with effect from date of receipt of application. There is no provision for extension of registration of U.K. trademarks as provided in many other Commonwealth Caribbean jurisdictions, but international priority (Paris Convention) is available, and a U.K. registration certificate may serve as evidence of registrability in the discretion of the Registry. Service marks are registrable under Trinidad
& Tobago's international (Nice Convention) classification system.
No local use or intent to use is necessary prior to application but failure
to use the mark within a period of five years following registration may
subject the mark to an action by an interested party for cancellation
of the mark by the Registry. Recently the registration term was changed
to 10 years and made renewable for like periods, and the same amendment
provided for registration of well known trademarks.
Authorisation of Agent form requires
no witnesses, no notarization and no legalization. The Authorisation of
Agent form must be supplied on A4 paper measuring exactly 8" x 13" with no less than
