The Trade Marks Ordinance provides for local trademark applications with registration dating from receipt of the application, as well as for registration of trademarks previously registered in the U.K. whereby rights under the U.K. registration are extended to Turks & Caicos with effect from the date of registration in the U.K.  

Service marks can now be registered in Turks & Caicos under the International Classification system.

No local use or intent to use is necessary prior to application but failure to use the trademark within a period of five years following registration may subject the trademark to an action by an interested party for cancellation by the Court.  International (Paris Convention) priority is now available.

Registration term on local applications is 10 years and is renewable for like periods. The  term of trademarks registered as U.K. extensions is coterminous with the underlying U.K. registration, as is the case in other Caribbean jurisdictions where a UK registration can be used as the basis for applying.

 

Authorisation of Agent form requires no witnesses, no notarization and no legalization.
